I'm a waitress and the boss just implemented a new rule saying that if you lost a credit card slip or have one that is unsigned you have to pay the amount that it was.I believe that this is like paying for the same meal twice and I don't know where that money is going.This has forced servers to sign any unsigned slips they have had throughout the day.Is the employer legally able to do this?

Its not legal at all. YOU can call the Credit card company to have them call the customer to have them come down and sign it, or give your permission over the phone.
Your employer is not allowed to take money from your earnings to pay for a meal that is already paid for.
report him to the labor board if his activities continue
and i would tell you to tell your other waitresses to stop signing those slips, because the customer can turn around a say "that's not my signautre" and contest the charges. they can be fired for that as that is a federal offense.

Credit Card slips? My god, I have not seen one of those in ages.
Most places use those scanner devices that scan the cards and then OKs the transaction and prints out a slip that you sign at the cash regiter. This prevents loss for the resturant and takes the chore of getting the transaction completed to the cashier, not the waitress who has other coustomers to take care of.
I would see about getting your boss to get one of those credit card scanners, it would save him money in the long run since the tranaction would be confirmed and he would not have to worry about bad cards.
As for the legality of it, if he can not collect from the credit card company becasue of a mistake you made. . . Well, someone has to pay for the meal.

My guess is that it's not legal. You could call your local labor relations board and see what they say, and if they say it's not legal file a complaint and get a written notice sent to the boss. Part of running a business is putting up with losses due to mistakes, but normally I don't think the business can just charge the employee.

Yes. Because if the business has no way to recoup money if you lost the credit card slip or it was unsigned so it's not paying for the meal twice you are the only one paying.

Red Lobster is a good one for doing that I think it is a crock that an employee has to pay out of their own pocket! this happens to a family member of mine that works there. I think they should be reported because how do you know if another employee is stealing?

I think its unfair for a waitress for that money to come outta their pocket. Its hard enough to make tips. I know been there and that job sucked.

NO. I don't think it is legal. Contact the better business bureal, unemployment office or your public defender. I would not work for some one that does that.

illegal, I don't believe so. You are responsible for collecting this
money. this employer is trying to run a business for profit. It
costs him money if he doesn't collect from somebody.
