I am a SAHM to 3 kids. I've been married for 10 yrs. I've been home for about 8 of those years. I am tired of being with my money-controlling, constantly angry so we all walk on eggshells when he's home, won't help me with anything husband. After this long haul, I am too tired to deal with him anymore. I have tried telling him that I need some loving (we rarely have sex - like 3x a year), and I try to really communicate with him, but he doesn't care or is uninterested. He refuses to go to councelling. I am currently looking for work, but I can't even find a job that will cover the daycare expense. He refuses to help with that because "I'm choosing to work". We are struggling money wise, everything I spend is micromanaged and I'm DONE. I would rather be poor with my kids than have a husband who is not there for me at all. How do I file when I have NO money to work with. I also want to add that I have no where to go either. No family, no friends to help, etc. It's just me and the kids.

I want to add that the pro-bono and other attorneys like that won't help me unless I'm not living here. I have no where to go, so I can't get help there yet.

I appreciate the credit card advice, but he shot my credit through the hole. I don't have any credit cards.

you can file with the court for a divorce with legal aid or do it yourself. when you file, file a fee waiver along with it. usually the court will grant you a no cost case if you are not bringing in any income. I filed and was only asked to pay 20 percent as i was not working full time.

Yes you should be able to provide proof to the judge that he has been removing money from the account. Collect any online transaction that you can. Tell him that you are aware of what is going on and this is not fair. Tell your husband that if he does not stop it then you will be forced to present such documentation to the courts. He should file and pay for the divorce. Do not offer a dime. Did you go to school during this time? Never sit at home and do nothing but raise kids you see how dogs are they lay down and get fleas and wanna blame you. Girl you better do something and get a grip.

Some lawyers will take your case free of charge if they are certain they can make the spouse pay for expenses. Most of them want a retainer of $1000 to take your case. You can file the paperwork yourself at the county courthouse. You don't NEED a lawyer to file for divorce. There's usually a filing fee, $30 or so. If your husband is going to be difficult with it, you could always get a lawyer at a later date. The best thing, and easiest, would probably be to borrow the money from someone. Good luck!

Many lawyers take credit cards to get the process started. If don't feel secure with him in the house and it's the primary residence for both of you, your attorney can have him pay for a separate place for you to live or through him out of the current house. Don't worry, the divorce understands the needs and realities of women like you and affords ample accommodations.

Through his stuff on the front porch and change the locks. Keep the phone number to the police available. It will be at least six months before the bank reposes anything. By that time the divorce will be final and you can sit back and collect child support. A man's worst nightmare.

Are bills/mortgage paid out of a joint checking/savings account? If so then you DO have money. If not you set up a "consult" with a lawyer. Most WILL give you a first time free consult, you EXPLAIN to them that he controls the money, they can (and probably will if it means money for them) tell you HOW you CAN get money from the bank account in order to file for divorce.

This great country has Welfare and the Welfare can help you file for a divorce. Don't worry about all that now, just get you and your kids a welfare check coming in so you can move out.
