My husbands daughter turned 18 last July. She is slightly mentally ill, but she graduated from high school, and was even in band. The divorce papers state that my husband has to pay until the court decides to stop child support. I just wonder if anyone has any idea if maybe the court might stop child support when she is 21, or maybe sooner? Thank You for any help anyone can give us.

In some states a disabled child can get lifelong help from both parents. It depends on factors like if she has a diagnosis and for instance if she continues to live at home under the care of her Mom. It is difficult to find an attorney for a case like this because it is a fairly new family issue. Best of luck to you!!

Most states continue the support payments until the child graduates from college as long as they can show they still need the support. Also if you owe any arrears, this is considered a debt and can be made payable throughout the child's life (adulthood). It never ends unless you were consistent in paying through the time of the order. You can also contact your local child support enforcement agency to get current information. Good Luck.

where i am, they pay until the child finishes college. if the child has special needs, that will be taken into consideration by the court, because the childs needs come first, before either parents needs.

to be sure, of any answer posted, contact your local legal aid office. they are in every state and most counties. they go on a sliding scale so its free to most. look in the phone book or call the county court clerks office and ask if they have it.

Actually I am sorry to tell you this but in Texas due to the child being disabled the court order can be modified and he could have to pay lifetime child support for the child if the child is unable to care for herself or uncapable of working.
