It appears that you are in TX...
No problem in TX..
You can file for divorce , without a lawyer, he does not have to
be present, or agree or sign anything...
You can download all the forms from the internet for about $15...
It costs about $170 to file with the court...
Once you have filed, your case is assigned a number ...
You wait 60 days and call the court and ask for a hearing date.
With a missing spouse, you may need to publish a public notice in a newspaper in his last known town of residence which may
delay the process a couple of weeks...It is cheap, quick & easy.

For a very small fee, the cost of copies at your local library you obtain the paper work, the you go to the courthouse and file the paper work for another fee. Then if must post the name and proceedings in the newspaper and they have 30days to respond to the notice. If no response the divorce is granted, if they respond they can appear in court and most likely will still be granted without good cause not to grant. Or hire an attorney. If you can not afford an attorney then you would call the legal aid society within your area. Check the laws within your state to see if this is correct. Expect 6 months to a year if you are trying to get custody.

File the divorce papers and they will try and serve the papers to other party ... if they don't show up for the hearing the judge will eventually grant the divorce.... just because someone disappears doesn't mean you have to stay married to them... this is very common... go ahead and file... good luck

You file the papers, have them sent to their last known address. If there is no response within the amount of time the court allows for response a default judgement of divorce will be decreed and you will get everything.

My now hubby had that problem (live in PA.) Our atty sent a letter to last known address and no response. He ran ads in the local papers and after a certain amt of time it will be granted anyway even if no response. Couple weeks have to run the ad he told us.

Yep, everybody hit the high points. The final piece is the public notice. After the time period lapses with no response a default dissolution is granted.

Check your local laws...I know in NV you can post an ad in the paper and if they dont respond by a certain time....you can divorce them even without the person appearing in court_
