I am a mother of a 1 year old who has his fathers last name. We were never married, and I have custody of our son (he pays child support). If I can get the fathers consent to change our childs last name to mine what would I have to do? If I can not get the fathers consent to change what could I do to get it changed?

If you live in the United States, you would have to have the father's permission to change the child's name to yours. You will still have to go before a judge either way. You can petition the court yourself and have the name changed even if the father doesn't give permission, but the judge would want a very valid reason for doing so. If this man is paying support, I don't think it's likely. And you will incur court costs as well as filing fees for court and name change.

File with the courts for a name change. They may require you to try to contact the father or at least make an honest attempt. You will have to post an ad in a newspaper once a week for four weeks then go to court shortly after that. When you post in the paper you can pick an obscure one as long as it is recognized by the courts.

My wife and I did it with our grand children, changed their name from the fathers to our last name. Then order new birth certificates with new name.

Legal aid told us any adult can change their name to whatever they want as long as it isn't for fraudulent purposes but to change a minors name it must go through the courts.

If you have custody and the father's not really in the picture -- though you should get his permission if you can -- I believe a judge can simply make that determination...but it has to be done in a legal setting to be legitimate.

If you get the fathers consent you can do a corection of birth certifacate and that should do it. And all I can say is good luck if he dont give consent. I have no idea on that.
