i have appliedfor adivorce from my husband we have been seperatedfor 3 years.wewere having cases nearly every week and now i have given up all my rights to his property,pensions etc we have agreeda mutual divorce all the other cases have been withdrawn now the judge says i have to wait 6 months i want this matter ended asi feel very stressed whatcan i do to request the judge to end this marriage now with immediate effect rather than wait for 6 months the caseis in jallandhar

Firstly if the Judge dealing your case has given a date of 6 months it must be that he is overloaded with cases. But your counsel should have prayed for an early date. Don't worry now you have already travelled so long wait for 6 months more for fresh air in your life. Even if you move the high court for earlier date it will cost you both time & money & by the time High Court of Punjab & Haryana order the District Court Of Jallandhar for early hearing of your matter the time of 6 months would have passed. This is your first experience in Indian Courts, I have 26 years old experience& know how the courts opperate here.

For all practical purposes you are already divorced and having waited three years surly you can wait another six months. What can anyone of us on Yahoo Answers do or say that will make the judge change his mind? Your lawyer is the only one that could do something. I suspect now that the end is in sight you are anxious to cross the finish line. I urge you to hang in there and before long it will be all over.

It's easier to get someones "forgiveness" than their Permission". The choice is yours, we can only influence you to make a decision. however it is inevitable that you have a connection with him for the rest of your life because of your child. Ask your child what she wants or what she will have wanted. What do you want? Yes you can divorce him, I would have, It's just that cheating is so much more serious when one is married. An annulment is usually better, it will not give you the label of being a divorced woman. Good luck

In Indian traditions diverce is not an instant one, but a final way out when all other options were tested and failed. Some emotions and hurried impressions should not put an end to married life. Such tendencies would damage our family system and sociey in turn. So elders felt the need to wait some time before resorting to such ultimate, but sad destination.

Because that's how long the system takes. It's not as simple as a judge saying "you're no longer married". There is paperwork and legalities. You said vows and entered into a contract that you are now breaking for whatever reason. You're going to have to wait.

People make rash decision when they're angry or upset. So it's just a cooling of period. Sometimes given time, people may realize it is their mistake and might resolve their issues. When you're mad or angry, it makes one to take rash decisions without proper thought. Given time , you will have a chance to analyze in clear mind.

And it's not just about living in India. In U.S (California and many other states) you've to wait for atleast 6 months.

WHO DID YOU THE FAVOUR OF STRAYING WITH YOUR HUSBAND IN THE FIRST PLACE SEND HIM BACK TO HER AND TELL HER TO KEEP HIM AND YOU GO OUT AND FIND SOME ONE BETTER AND THIS TIME MAKE SURE HE HAS A GOOD BRAIN.
PLEASE DON'T CHANGE YOUR MIND.ONCE 6 MONTHS GOES BY YOU WILL BE FEE SO LONG YOU WAITED 6 MONTHS MORE IS NOTHING.
SO BE STRONG AND DON'T LET HIM GET AWAY EASILY.
STAY SINGLE AFTER THAT,ALL MEN ARE TOTAL LOOSER'S NOT WORTH YOUR LOVE.

6 Months means, Judge looks your patience, so you may think again to come together. An if you are staying away for more than 3 years than it will not take six months

You waited for 3 years I do not think it will harm you for next 6 months. You will enjoy your stay in "No-man's land" You will also get time to think for your future plans if you are planning to get married again.

6 months' period is the statutory compliance with the provisions of law under H.M.A.
You will have to wait for 6 months.
