My friend was fired back in November of this year for having use her email for personal use (which was complaining about an Asst. Manager and the email was sent to the General Manager). This same Asst Manager is the one that went over her Managers head and got her fired.
She was smart enough to forward all the complain emails to her home address. Her concern is that since florida is a "at-will" state for employment (you can get fired for any reason) but the company policy that she signed when she first got hired states that for any first offense, (breaking email policy in this case) she gets a verbal warning, 2nd is a write up, 3rd suspension, 4th termination.
She did not get a warning - was told by her manager (who didnt want her fired) that she was told that she had to let her go. She was denied unemployment because they consider it "misconduct" & has appealed. Any chance she will win this case?
She has all the complaint emails and they still have not paid her last check
