Alot of you people are missing something here. People do not have to carry medical insurance. A husband does not have to carry medical insurance on his family. It is not a law, like car insurance. Certainly-its stupid not to have it but legally you dont have to carry medical insurance. If you legally had to carry it there would be alot of families going to jail because they cant afford it. Thus, i dont see how this man could legally have to carry medical insurance on this woman.
I dont have medical insurance right now. Am i violating the law in some way or some form?

"Soon-to-be-ex" means you're still legally married. He can't terminate insurance simply because he feels like it. Be really clear with your lawyer about what he is doing and has done. Keep lots of detailed records. And if he's over the age of 23 (usually), not in school and his parents are not his "guardians" then most insurance companies will not cover him medically. And the only way your kids should be able to be on their policy is if they have legal guardianship... I would definitely be talking with my lawyer!

I think it is illegal to cancel insurance on you without notification and approval by the court. It's all part of the many confusing issues that have to be decided in the final divorce decree. The final ruling on your divorce might even state that he has to keep insurance on you as a part of your spousal support, although if he gets permanent custody then you will be the one paying support.

Divorce law varies from state to state. In your case it would appear that your attorney would be the best source of valid information. Generally if you have a legal separation your bills might no longer be your husbands responsibility, however if you are still married and don't have a legal separation or property settlement, then the bills might be considered joint or his responsibility. Again your attorney is the one to consult on this.

Morally yes he should. Legally, i dont know why he would have to. Is a husband legally responsible to keep insurance on a wife? I dont think so. You dont legally have to have medical insurance. Its not a crime not to have it or not to provide it to your family.

No-one is obligated to carry insurance - it's a choice we all make. So no, there is no reason he needs to continue.

I agree with the other poster, you don't want him but want his insurance??? No he isn't responsible for you. You are an adult.. Unless the judge decides for it, which is unlikely if he remains to have primary custody...

No he is not obligated by law to support you in any way until the divorce is final,then his obligatiions will be prorated.

I think until the divorce is final he is still obligated to support you and the kids, at least as far as your insurance is concerned.
