My group wants to record a cappella versions of several popular (not a cappella) songs, some still under copyright. We don't plan on selling the CDs; we may possibly accept donations. Since we're doing this non-commercially, do we have to pay the compulsary license fee for use of the copyrighted songs?

do whatever the heck you want to with it as long as you don't get caught. It's only illegal when you get caught!

To be safe, you need to check with the company that owns the copywrite on the popular songs.

If you accept donations instead of "selling" them, then you'd probably be okay. Just make it clear that you're "suggesting" a donation amount, if people wish to own a cd... :)

Yeah, its legal to record a cd of your version of other people's songs as long as you do not sell it or give it to anyone as a promotion or exchange for coming to a show or other stuff like that.

I would think that can be compared to someone going to a jewlery store and stealing a watch for his own personal use and not selling it.

No, it's an infringement of the copyright laws either way it goes (also known as piracy)

If you dont accept donations then I think you will be fine. I am not sure though if you are going to accept donations.
