This gets tricky. If she is on the deed, you just cannot remove her unless she wants to be removed. If you bought the house before you got married, then I think she may have some trouble getting half of it, unless of course you have children and she gets custody. I would consult a lawyer and for your sake I hope it doesn't get ugly.

From what I understand from my husbands divorce, if you can sell it before the papers are filed then she can't have any of it. Or if you take your name off of the deed before papers are filed.
Of course I'm not a lawyer, you need to ask one.

Yea you should prob. do that. Cuz i know that theres been cases where men divorced and remarried a women with money. And the wife even got to tax that.

If you are a community property state she could. And, if you owned the home at the time of your divorce or separation, but suddenly dumped it, her lawyer could claim that you are trying to hide assets.

She can and is entitled to half of the accumulated value of the home since she has lived in it...like say your homes value went up 80,000...she would get40,000 of it.
