Sure. Anytime you take anything without asking, it's stealing. If you take from a business, it's robbery. On a literal level, a stolen pen is a bank robbery, but the phrase has become more synonymous with what is called a "holdup." (i.e., demanding money at gunpoint)

It depends on whether or not you are in political favor. If you pay your taxes without complaining and say only good things about the federal police, probably not. But if the government had an ulterior reason for wanting to arrest and/or stomp you to death, any little thing you do, like walking off with a bank teller's ballpoint pen, can be used as an excuse to attack you, and (assuming that they don't kill you on the spot) carry you off to federal prison to endure years of harrassment.

I worked at many banks and I am the biggest pen thief in the world (especially those expensive engraved ones) ... but luckily, they want you to steal the ones with their logo, it's advertising.
