Last week, it was learned that DNA testing arranged by the prosecution at a private laboratory found genetic material from several men on the stripper's underwear and body, but that none of it came from the players.

"The reality is, what else could the DA do?" said Stan Goldman, who teaches criminal law at Loyola Law School in Los Angeles. "Once the DNA evidence came out last week, I can't imagine how they could sustain a rape charge."

But Wendy Murphy, a former prosecutor who teaches at the New England School of Law, said the decision could actually help Nifong by keeping any discussion about the results of the DNA testing away from the jury.

"It may be that this is a strategic move to insulate the trial itself from a sideshow that certainly would have overwhelmed all the other evidence," Murphy said. "A sideshow about her sex life."

As a woman I can tell you, there is no way after being gang raped, that I would feel comfortable being around another man for a very long time, less having sex with one which cause her pregnancy. And the prosecutor in this case should be prosecuted himself. Did you know he didn't even meet her at all until yesterday? He has had NO substantial evidence at all, but instead wuite the opposite. There have been piles and piles of evidence showing the men were innocent, and now they have been drug through the mud because of this guy. In my eyes, both the prostitute and the prosecutor are at fault and should both be tried in court.

I'm not sure if she's a drunken whore any more than a lot of college students including the Lacrosse team. I see nothing wrong with her getting drunk or having sex with adults.

What bothers me in these cases is that rape shield laws make great effort to protect the accusers identities but allow the pictures and names and addresses of the alleged criminals (in this case, the real victims) to be broadcast across the world. I can see why alleged victims should be protected but then why not protect the accused? They are supposed to be considered innocent until proven guilty. This creates a Salem Witch trial atmosphere in which nut jobs can accuse people just to be vindictive. In college cases the accused get thrown out of school, they get shunned by friends and family. A lot of lives are ruined by this woman's lie and they will never be the same. No amount of DNA evidence will ever really exonerate them in the minds of the world.

I agree with you completely. I honestly had an open mind about the case until evidence showed me something one way or the other. The alleged "victim" is obviously a lying, drunken whore. She deserves to be prosecuted for all that she put these young men through.

Yes, she is a prostitute, and probably a drug addict. I believe she thought she could get an easy payday from some rich college students. Her story unraveled quickly, she now can't even say if she was raped or not. The prosecutor should be fired and sued by the families of the victims. Victims being the accused Duke students.

Some of the people on this site are just plain ignorant. Yes she was a black stripper, who was paid to do what she does in front of white boys. Why does that make her a drug addict and a whore? I guess since these boys were probably using objects, or having anal sex with her, that makes them angels, not whores...right?

It sure seems that she isn't a reliable witness doesn't it? I questioned this case's validity from day one. Not that these young men aren't spoiled punks, but there were serious holes in her account of the incident and she doesn't present the best in credibility.

Well she may be lying, but none of US were there. The Duke students paid 2 black strippers to come and shake their goodies at a party, so lets not start this white / black crap. Everyone at the party was an adult. Seven different semen samples were found on the girl’s pantys. Somebody did something to her.

It’s always much easier to vilify the black, especially a female, but keep in mind, she was a paid guest; the boys are culpable.
