My sister just got laid off from her job today. The reason...She was in a car accident in the company vehicle. All parties involved agree that she is 100% NOT AT FAULT. Even her boss says it wasn't her fault but he laid her off today because his insurance is going to go up now. Is this legal? She lives in California.

There was only bumper damage.. Oh and to the jerk that said she was ugly...My sister is gorgeous, you would sell your soul for a date with her.

we work and live in an at will country you work for someone at will and they allow you to work for them at will... you can quite at will and they can let you go at will....

Hairy Topic......Yes it is probably legal in Calif. Laws differ from state to state. It also would depend what the compan policy is on driving a company car. I've been a fleet manager now for 4 years, and these things can get real messed up. Every State and company policy is different. But if the company policy has something about wrecks (no matter whos fault) leads to termination, then by all means it is legal. Hope this helps.

Different states, different laws. However, most insurance companies won't raise rates on clients for accidents where their drivers are not at fault. I do believe that any employer can "lay off" anyone for any reason. If you don't believe the reason given for the termination you can always fight it. In my personal experience, if it is your word against the employer, the employer will win because they are the ones paying the unemployment insurance. Good luck to your sister.

i dont think so....... sorry! but i would like ta know why would she get laid off? especially if she was not at fault! plus why would the company get mad at her and lay her off if the company insurance would pay it off........ yeah so what if the insurance would go up. ITS NOT HER FAULT! and that is what insurance is for. just be glad that she is okay and that she doesn't have to pay it! my best advice is to call the company, scream my head off at who ever laid her off (not her boss...... the person who is higher than that! lol) and get me a better job...... trust me, shes in Cali....... grab the classifieds from the newspaper and find a better paying, better quality, better insurance towards cars, and a company that doesn't lay off people when its not their fault job!!!!!!!!!!!! good luck!!! (ha ha ha---- not at the situation, at the really really really long sentence i just "said" or "typed"!!!!! ha ha ha)

Once again, this is why I disagree with the right to work laws of California and Texas. They do not have to employ you. It is considered "a privilage" that they are employing you. As long as no discrimination laws were violated, there is nothing you can do. Check the company and see if any males were in the same situation but kept their jobs, you would have a lawsuit for wrongful termination and sexual discrimination and or/ sexual harassment.

It's legal for any company to lay off any employee at any time unless they have a contract in place. Most companies just don't do it without reason, so they won't get a bad reputation.

It seems that the company is getting back at your sister for the accident and they see her ask a risk. Laws vary from state to state and you need to consult attorneys in you area, not the Yahoo community.

I guess a boss could lay off anyone for any reason. At least he used the term "laid off" rather than fired.

If California is an Employment at Will state it is not. They would use another reason for the layoff. If your sister believes it is retaliation she should go to the Dept of Labor.

If I'm not mistaken, Cali is a "right to work" state, as is Texas. I was told by a dept of labor worker, that being in a right to work state meant that your employer could tell you" pick that up", and then fire you for picking it up.
