Unfortunately, I believe so. But try checking it out with the Labor Board, they may have that answer for you.

A few years ago I took a Private Investigations course. The class was told that you can record conversations only between yourself and someone else, and if someone nearby is accidentally recorded that is not legal - that portion of the recording cannot be used. He was an experienced PI, so I'm inclined to believe him, and he was teaching at Niagara College in Niagara-on-the-Lake. Assuming that this is true, it is also illegal to tape a conversation between two other people (not including yourself).

I'm sure they can ...I just don't know if they can use it against you. If you are in customer care or have to call out to people often, the chances are high that it is policy for some calls to be randomly recorded.
