K so my bf been paying about $1000 for child support. They agreed on partial custody. His ex wife is taking the money for her and her boyfriend and not using it for the 2 kids needs. When ever they need something my bf ends up paying for it. He as been given her half every two weeks, but latley he's been giving her all one lump sum at the end of the month. Now that it's the holiday she wants her money early, but my bf doesn't have it til next week when it's due. She told him that she already spoke with her lawyer and that she's gona get him for more money and that cuz the child support never went through the courts she's goin to say he hasn't been paying her any money. That's over 25,000! My bf has check stubs and that's about it. Can he win this when she takes him to court? Or any suggestions of what he can do?

He should seek custody while he is at it!

As long as he can document payment he's fine, but in actuallity it doesn't matter since it isn't even court ordered. 1000 a month sounds like A LOT of money and I wouldn't be worried about a lawyer if he is paying that much. If she wants to spend money on a lawyer, that's up to her, but she may find herself getting less if your bf is willing to stand up for himself and get a court to determine the dollar figure. How people afford that crap I will never understand. Seems like automatic poverty to me.

If he has checks to prove payment, then he should be OK about the back pay. He needs to get a lawyer right away and combat this biatch from hell and smite justice into her sorry a*ss. Make sure you have proof of payment for every dime he has given her.

If he has proof that he has been paying her then yes he can win in court but if he has no proof then he is most likely screwed. Always either pay by check or get a receipt.

Is there a court order for child support? Or just an agreement? he should seek legal advise.
