I am in arrogance with most here. It really all depends on the state in which you live in.
I suggest finding the best family/divorce attorney. Granted you will spend some money but it the long run it will be worth it.
I suggest you document document document.
You need to make a list of items in which you want to keep, list of the bills, assets and dates in which the items were purchased. You need to know her income as best you can, to establish child support. Even though she left she still needs to pay as the child is just as much her responsibility as yours. If you own a home, then you need to make it known you are entitled to the house as you provide housing for your minor child you share together. You also need to document all times she calls, takes the child or visits the child.
All these will come in handy and when you go to the attorney you have done a lot of the leg work for him and he will be faster on filing in the courts.
YOU SHOULD FIRST AND FOR MOST MAKE SURE YOU FILE BEFORE SHE DOES.

this questions sounds as if the woman is asking the question.
Depending on the State you live in, but usually if it's a community
property state,yes the woman gets l/2 of everything no matter
what the circumstances are.
I can understand why you would leave your husband after 14 years.
No more love, no more passion, different interest, people outgrow
each other sometimes, but that doesn't mean their bad or insensitive. I don't agree that you are leaving your child. The most
precious asset one has in life. Do you feel he might be a better
parent than you. Be honest with yourself. You didn't say
how old the child is but if we're talking about a teenager then
I think the child is owed an explanation. Tell him you will always
love him, but you can't live with his father any more.. DO NOT
TRASH HIS DAD.
Also pay your child support or you will be thrown in jail just like
any man who neglects his obligation. Visit with your son as
often as you can, NOT WITH YOUR NEW MAN, a nice outing
just you and your child. Try to attend all of his award ceremonies
and tell him how much you love him, often....Remember you
will not be remembered fondly by the family so try to make
amends slowly, don't be pushy and be reasonable if at first
they done respond.
As usual I go off, but YES you are entitled to 50% of everything
if you live in a Community Property State, the laws are different in a
common-law State. I suggest you get an attorney to represent
you, but don't screw your husband twice.....I wish you much
luck and I will pray for you for the sake of your child's happiness.

It says your leaving your husband and kid ! Well in that case you will get very little and may have to pay him child support to boot. Can't this other man give you all the things you need. ? Why should you feel your husband and child should give you anything. That is how the court will see it. I have Big news for you. You and this man will not work out ! Then your going to want to go back home and your hubby now will say no! I see this in your future. So sad. The grass is not greener on the other side. It would look a whole lot better in court if things are done in the right order...if your not happy in a marriage, leave for you.....the new relationship should come later. In some states adultery is harsh...but chances are she will still get close to half.

maybe see a lawyer pronto.. that is infidelity and usually the person with the child gets most of the property and stuff.. also judges don't look to kindly when the women or the man leave one for another and you can prove she is unfaithful.. and angel we dont know if the person asking is a male or female...this could be the man not the women

It depends on the states laws actually, but she really will get half of everything in most cases. My husband got custody of his son and he got to keep the home but he had to give half of everything to his ex-wife. She left to move in with her boyfriend and left her son behind and still my husband had to pay her half the value of the home and everything else. I would check with a lawyer.

This has nothing to do with your child, it has everything to do with you and her. Leave the kid out of it. In today's world women (even if they are stay at home Moms) are entitled to half of everything. Welcome to the world of equality, all of what you had together is legally half HERS.

have to seek the advice of an attorney in the state where u live, maybe the one with the child gets to keep the marital home.maybe they will take abandonment under consideration.
