I need more info to know "if its the right thing to do". He is legally entitled to half. However, if he just sits around all day and doesn't care for the kids and household while you are working, I'd say he is not only not entitled to 1/2 the refund, he's not entitled to you or the kids. Get out now.

You are married and this makes the tax return a "marital asset", i do believe in all of the states, therefore, yes, he is entitled unless the two of you agree to other arrangements.

You could file married separate instead of married joint returns - then the money is all yours.

If his name in on the return along with yours, it's a joint refund. Sounds like if he hasn't worked in over a year...any refund money should be used for the children's needs or to catch up on some bills.

Yes 1/2 of the money you make actually belongs to him.Your income is considered marrital property.married people actually have only a small amount of personal property,their clothes,gifts given to them,inherited items.When it comes down to it you own half of everything but actually you personaly have almost nothing.Put him to work or someday if you divorce you may end up paying alamony.

If you file a joint return and take all the deductions entitled to a married couple of course he is entitled to half the refund.

If he hasn't worked, most likely he hasn;t paid income tax. If he hasn't paid income taxes above and beyond the amount he needed to pay he will not get a tax refund. Unless he is disabled he should be working.

If it's a tax refund it's either his or yours, they do come slowly so it could be his from his last job. Being a home dad is a full job too.

My husband supported us for 39 years. We always had joint tax return. Was I not intitled to it?
