By your own statements, no he should not be.
If a drug dealer gives junky heroin and they OD, the drug dealer should go to jail for selling drugs. The fact that the junky OD does not mean he is going to be charged with murder.
I have heard many good arguments against Kevorkian, this is by far, the worst.

Kevorkian should not be in jail. The heroin dealer should be charged with selling but not assisted suicide. The junky chooses to take the drugs and if the amount he takes causes an overdose that's his own fault.

No, provided he provided appropriate counciling and ensured that the patient had the mental capacity to make the decision.
If an intelligent, rational and mentally stable person has the right to defend their life, then they have the right to choose to end it.
One argument is that no rational being would choose to end his own life, however there are situations where this is not true. A young man might choose to end his own life to defend others. Many contend that it is not irrational for the very old or terminally ill to choose to end their life rather than to suffer with no prospect of recovery.
A drug dealer could be held liable for providing a potentially deadly product to someone he could resonably expect to use the product in a dangerous way if he did not provide a reasonable level of instruction in the use of the product and also verify that the user had the mental and physical capacity to be reasonably expected to use the product safely.
So yes, a dealer who sells a product to a junky could possibly be charged (probably with something like criminal neglegence). If he knew that the user intended to use the product to commit suicide and he provided instruction in the method then he could probably be charged with assisting in a suicide. If it could not be shown that the dealer had knowledge of the users desire to commit suicide then he would not be liable (although he'd still be charged under various drug laws).

If someone chooses to end their lives with dignity rather than watch themselves rot away I believe they should have that right. It's funny to me that our government feels it has the right to mettle with choices that affect only the person making the choice (and before you can say that suicide is a selfish act, think how selfish it is to make someone live against their will so you can feel confortable knowing they are alive).
In short, I think that Dr. Kevorkian never should have been incarcerated. He documented the best he knew how to show these people wanted the services he provided. People need to get over death being a bad thing...

Yes, he should. He broke the law. He could have been an activist and worked to change the law if he didn't agree with it, but that's not what he did. Disagreeing with a law, doesn't mean you can break it and not be punished.
A heroin dealer whose customer dies is guilty of a few serious crimes, but I don't think assisted suicide is one of them.

Jack Kevorkian should not be in jail? Michigan elected officials made a law, under, Engler, just to put Kevorkian behind bars.

No, he never should have been in jail. Part of living in a free country should be the decision to end your life, especially in the case of terminally ill patients.
As far as your heroin analogy goes, look at the John Belushi death, Cathy Smith was convicted of manslaughter.

a MD takes an oath to keep their patients from as much pain as possible ..My doc won't even give me pain pills to help my pain and I have a chronic pain condition.. I think what he did was totally correct. I wish docs here had that much compassion. What is so wrong with letting someone die with humanity rather than suffering for years.. it should be legalized. If you are an adult, in good mental condition, that should be your choice.. I lie in bed many days and cry in pain I can't imagine having cancer and the pain NEVER going away..how sad that we don't care about the patients suffering anymore.

After what the Doctor's did to Terry Schivo I would say no! How can lawmakers justify starving someone for weeks, and Jack Kervorkian be wrong?
