my husbands mother died. She had breast cancer that lead to brain cancer. Four days before her passing, her sister, my husbands aunt minipulated her into changing the will for reasons we dont know of. She did, his two sisters i think knew but didnt say anything to him because of statue of limitations. Well anyways the two sisters got 45% and my husband got 5%, now the sisters all of a sudden dropped all contact with him for the sake of not doing the right thing and split it in 3 ways. What would you do in this situation?

You have to be able to prove that the mother was incompetent when she changed her will. That will leave the updated version null and void. But this is hard to do. Good luck.

Your husband can contact a lawyer and contest the will. Explain thr circumstance and more than likely it can be proven that she changed the will under duress given the subsuquent behavior of the sisters. But if the statute of limitations has in fact passed at this point it is simply too late and he must accept what little he has left of his mother, appreciate all the memories and continue to build a life with his current family.

Your husband should probably look deeper into this. Like was his Mother of sound mind when she did this? When is the new will dated? Was his Mother in the hospital on that date? Is it really her signature? Lots of things to look at. Maybe he should see a Lawyer.

It depends on two things- how much money you're fighting over, & how much you want to spend to fight for it. it sounds like you would probably have good grounds to contest the will change. She was probably not of sound mind at that time.

He can contest the will in probate court since this was done while she was probably under pain medications. He should talk to an attorney and tell him/her what happened.

nothing. Take the high road...I know its easy for me to say...but I'm sure your mother in law would be disgusted by their lack of respect and wouldn't want an all out family fight

Contact a lawyer. There may a case for duress.
