First of all you don't have to sue them if you present the case to a courtroom. The Judge will not be amused and your lawyer will do a good job at finding your seassucking douchebag soon to be ex guilty and you will recieve more than what you expected plus a good laugh at how stupid he is going to look in the end when everyone makes a fool of him

He can't not cooperate for extortion. Call a lawyer, and even if you only use them for a cease and desist order, it's worth it for that. If you're going to spend 1000 bucks on the divorce, use it for a lawyer, don't give it to your ex.

As long as you have him served, there's nothing he can do. He can not sign, but it's the judge's decision whether or not to grant the divorce, so just buff up on the reasons you don't want to be married to him anymore so that you can present that to the judge when it's time.

I divorced my first husband on my own, without a lawyer. I used the book that's got all the paperwork in it. Did it all myself, and I was pregnant. The only thing the judge wanted to know was what our plans with the baby were, and I told him I didn't want help. I got the divorce final six months from the day of filing it.

If you have proof of this, and depending on the circumstances, you can sue for extortion. You'll also be able to complete the divorce with something like this.

If the extortion doesn't hold up in court for grounds for divorce, you can consider using "constructive abandonment" for grounds.

My best advice is to consult a lawyer that specializes in marriage/divorce, and they might also refer you to a colleague for the civil suit.

Your ex does not have to cooperate. If you can't agree on the divorce a judge will take care of it for you. Your attorney should explain this to you. Your ex can only drag it out so long before the court will step in.

You need to talk to a lawyer. You haven't provided enough information. There are too many variables to give an intelligent answer.

Word of advice...document everything! If any moneys are mutual to the marriage, document who has how much and when they got those moneys from a join account or source. Details. You are at war.

Good luck. I pray there aren't any kids involved. It will just take longer.

If she's already married to somebody else, her marriage on your fiance is promptly annulled. you purely would desire to get your hand on a replica of her marriage certificates. There are 2 a thank you to try this -- your fiance can get a replica of her marriage certificates and take it to divorce courtroom and get a "very final" divorce. The decide is familiar with if she's married already to somebody else, there is not any thank you to salvage the marriage along with her ex-husband. The decide will finalize the divorce regardless of out her presence. it particularly is fairly much less difficult than 2d option. So attempt to try this. The long bumpy way is to, when you have a replica of her marriage certificates, report a petition with a divorce courtroom for a listening to (your fiance does this) and restore a replica of their marriage certificates to it which exhibits she is married to somebody else. Have the courtroom officer (bailiff) serve her the paper. She has to sign whilst she is served and he or she has to look for the listening to. then the decide gets carry of her signature suitable there. If she would not look for the listening to you could report for a no-instruct and function her served by using the bailiff lower back. If she would not instruct two times, you could ask the decide to subject a bench warrant for her arrest. Your fiance purely needs to get carry of a replica of her marriage certificates in Reno, that's a controversy of public information so he can extremely try this. something is easy!

I suggest you speak to a police officer, thats blackmail, and doesnt he figure that he can just try and get that in the divorce settlement? What reason could he have to stay married to you when you dont want to be married! You can try speaking to someone online (there are lawyer sites)
