What is the first step in getting a divorce? Who do I got to first?Do you have to go to court?

The first step is finding yourself an attorney and telling him/her what you want in the papers. Then they make up the papers, with child support request, personal property, shared property, etc. Then its on from there. I had to go to court, because I had a son and wanted full custody and child support. Good luck.

First thing you gotta know is that Divorce and Custody is a very expensive process.....However, if you dont have children thats like 75% of the battle gone. I would recommend you to make an appt to speak to a Family Law Facilitators (You tell them what the problem is and what you plan to do and they help you fill out the proper forms, FOR FREE). Then you turn in the paperwork and you go to court, but you represent yourself. Now, if you have a lot of things that your trying to fight for, to keep, then I suggest you get a lawyer and them ******* can get expensive quick!! So it kinda depends on how financially stable you are. GOOD LUCK!!

Try to talk to your spouse for an equitable division of assets. If you cannot agree go see a lawyer and get the divorce papers served. It will cost you $250-$300 /hour and may run 20K to 40K depending on how long it takes and what you have to divide. So if you like to split the assets between you and your spouse and not the laywer, you have to work it out between yourself or using a mediator.

Which state are you in? Laws concering division of assets are different based on states.

Go to your husband and tell him you want a divorce. If you have no children it can be pretty quick and easy if you both agree on who gets what. Then go see an attorney.
IF you have children or property issues, go see an attorney first.

A lot of this depends on the laws in the state where you live. You may need an attorney, or you and your husband may fill out the proper paperwork that can simply be handed to a clerk... and it will be taken care of. If there are childre, all of this can become very complicated. Call your county clerk for more information.

Lawyer if you and your partner can't agree on how to split things up between you but if you can do that as two civil people its actually possible to do online and just mail or fax the papers to the place it tells you to. atleast in Connecticut you can but I know other states have similar systems
