I recently had a child support order established for my kids who are 10 and 12. I live in GA, and they live in VA. I just recently received an order of custody AFTER the child support order. It says the mother has physical custody in VA, yet it also says it is an order for joint custody. Am I still required to pay the full amount of support? I will have my kids spring break, every summer, and every other holiday (xgiving and xmas).

It probably says joint legal custody, this usually means you can have input into important decisions, such as medical treatment and things like that....you still have to pay the same amount of child support since the other parent has physical custody.

yes you still have to pay child support the only time you would not have to pay is if the kids stay with you for more than a week which you have to have proof of that other than that the only way you will not have to pay child support is to get physical custody or soul custody

I think it does depend on the states, but if you need the child support order changed, you need to go back to court. Also, yes they can order you to pay child support even if you have joint custody. My boyfriend has joint custody (50/50) of his youngest and as his income is higher than the child's mother, he has to pay her (but in our case it is only $30 a month). We are in colorado.
Contact the courts where the case was taken care of and ask them what your options are.

yes you will have to pay the full amount either way you go...... But I would speak with my ex and see if you could keep the money for summer break so the kids could have some to spend... but the other breaks wouldn't matter.......... Even though you have joint custody means nothing when it comes to child support... she has physical custody and the kids live with her so she gets the money every month.......

You have to pay the full amount unless your court order specifically says you pay less (or not at all) during holidays or long visits. I doubt that you have them long enough for that to have happened during spring break, Thanksgiving, and Christmas, so all we're really talking about is the summer. Sometimes the noncustodial parent gets credit for summer visitation, sometimes not.

But you've already been to court at least twice. How do you want your kids to see you - as ready, willing, and able to take care of them, or as whining about the child support?

yes you silly man. joint custody only applies to the legal well being of the child such as medical decisions and legal decisions. unless you have the children 50 percent of the time, you are always obligated to pay and from the look of it....you seem to only have them 5 percent. child custody and support are two different things. support is based on how much time both parents are with each child and who supports them on a day to day business.

Yes, I think you still have to pay, although you could always ask your attorney if you can petition the courts to a lesser amount during the times they are with you, i.e. summer months. I have step kids, and regardless of how much time they spend/spent with us, we paid child support. You should never modify the payment or make it in cash unless you get a signed receipt from your ex-wife. Try not to be resentful of your child support payments, try to think of it in terms of help for your kids, because they aren't stupid and they might pick up on that.

You need to ask the court or your attorney this. If you feel an attorney is too expensive ask yourself what it will cost if you end up in jail, or if you have your pay garnished.

Its not about who has the kids it about the children lifstyle when you were married. The attampt is to make the kids have the same life style in both homes.. The bottom line is if you make more than your Ex you will pay her or Him Child support
