He is behind in payments and I was wondering if he would at least be obligated to pay what he already owes.

My wife went through this when I adopted her two children from her first marriage. He still owes the arrears, but does not have any obligations any longer after terminating his rights. My wife was told that only she can forgive his arrears. She has no plans to do that. He owes over $25,000 in arrears.

Giving up parental rights simply means you no longer wish to take part in the child's life. It doesn't mean you are no longer responsible for supporting the life you created. In addition, he is certainly responsible for all child support he incurred while still having parental rights.

So, yes, he will have to pay.

yes nothing changes arrears, the only thing that can change them is if the person owed them waves arrears owed to them witch never happens
