Well, under the current nazi-like regime in Washington DC it probably would disqualify a potential Candidate from being nominated. Once a candidate is nominated I think the congress would not let something like that sway their decision about being a Federal Judge. Remeber, marriage laws are not Federal, they are mandated by the states.
