We have not filed seperation papers but are not living together. He has kinda hooked up with my best friend/cousin. They say they are "just friends". But he says that because we are not living together that we are considered seperated and that he can date. Is this true?

I think that it is wrong what he is doing. We haven't discussed it and he thinks I broke my vows cause I was having an emotional relationship with another guy while we were still living together.

You have to understand you are separated it means detached, and disconnected, and in your situation stop living together as a couple, on that note your husband needs to full fill his needs and looking for a companion, and your best friends cousin is most likely filling that position, so I think they are having an emotional relationship, just like what you and your friend had before you and your boyfriend broke up, don't you think? Its always a two way street, its almost like payback, relationships can be difficult sometimes, you always have to think about your next move its almost like a game off chess. Be care full in this game called love, play it wise if you want to be check mate

That would entirely depend on what you consider moral or not. For some with very strict morals, they would say that you cannot date until after the divorce has ratified. Others would say you could do it as long as you both consider yourself separated. Still others date while still married to another. If is up to your own morals.

You are more than separated. He is done because he isn't worried about reconciliation or if your hurt.
Sorry, but if he is messing around he has no intentions of getting back together. Your not sure if he is messing around, you need to find out. If he is, move on because he isn't worth it.

If you guys are going to go through a huge divorce and fight for money and property then I wouldn't date...Because if you can prove that he is dating her you can win the battle, cause he is being unfaithfull.

In his mind it's true.

In reality, married or not... He can date other people.

Is it morally wrong? YES!

Would a Court have an issue with it? Not if you live in a "No Fault" state.

Will it make him look as if he's cheating? YES.

He can do what ever he wants to do, I think his actions speaks volume on how he feels about you & your marriage. There's always another path in life.

Legally speaking, if you're not legally separated and he is seeing someone else that is called adultery. Adultery is grounds for divorce.
