been separated a long time (10 yrs). due 2 lack of $ never got divorce, but in '07 want that divorce. husband is military retiree -- what is the cheapest route i can take 2 get divorce? i am poor.

okay getting great answers. thanks. now the problem is i have no idea where he is, no phone #, no address, nothing. Can I still do the divorce thing on my own like some of you are suggesting? even w/him owing money and i'm entitled to pension?

contested, uncontested, abandonment.

I did my own divorce many years ago and use to also assist others to do their own, its actually not complicated if its uncontested. If it will be contested you will need a Lawyer.

My advise to you is go to the library and read up on the laws in the area that your in.

I found that you can purchase the proper paperwork at any store that sells legal documents, many years ago it was 5 cents a copy and you will need several copies for the different requirements.

Complete them yourself, you will need the proper legal wordings or it will be rejected but you can get them at your local library. For example, when it asks your marital status prior to marriage, a male is a bachelor and a female is a spinster. I know it sounds degrading but it's the legal term that needs to be used.

You need to file the Petition for Divorce papers at the court and then you can serve him through the newspaper.

The way the law reads all you need to do is post it in the local newspaper of what ever place you think he resides. If he doesn't live there then its his problem. After you have done that for the required time frame you file for your decree Nisi.

Then you go in front of a judge and he will grant you a decree Nisi, after that you wait the designated time frame (usually 3 months) then file the Request for Decree Absolute with the court to finalize it.

If there are minor children involved a copy of the papers also need to be filed with the registry office for each one of them from the start.

Once you file for your Decree Absolute your divorce is final within 48 hours.

Look in the phone book and find a divorce attorney who will file uncontested divorces. Many times you will find an ad for a divorce clinic or something in the yellow pages. These attorneys will file an uncontested divorce for you for very little money. All you pay is for the paperwork and the attorney does everything through the mail. You also might try goiong online to see if there are divorce clinics in your area you can contact.

You can try serving him at his last known address and when that doesn't work you can put the Notice in the newspaper (this could cost about $200)--but he has to have notice...then if he doesn't respond, you can get a default against him.

You need to find him though b/c you are entitled to part of his military benefits and retirement and stuff like that. Does he have a brother or mom still alive who can tell you where he is?

Find him and he can split the cost of the divorce with you too.

I got a divorce with a do it yourself packet. Cost $25 at YWCA, and is a fill in the blanks divorce, then go to the court house and file, if you are low income you can have your filing fee wavied.
I would let the guy keep his retirement, you said yourself you havent been there for almost 10 years.
you can send papers to his last know address and advertise in the paper. Its will go through...

Find out what the court filing fee is . .. if you both agree to the divorce and are willing to agree to how to split property you should be able to just file w/the court and not need an attorney. That would be the cheapest route.

You should be able to get an uncontested divorce for $500, maybe less (will he split the cost?) Uncontested means no kids, shared property, assets, etc.
