Your child cannot be adopted by your new spouse unless his other parent voluntarily gives up his parental rights. If the child's biological parent will not give up parental rights, there is no way for your new spouse to adopt him.

Your new spouse would be a fool to adopt your child. If the marriage breaks up your spouse may be resposible for child support for a kid that's not even thiers. Further, it would be better to go after the biological parent for support and use that extra income for the benefit of the child. Just my opinion.
