My employer is a small family owned and operated company. I am a single person. She thinks she can get away with treating me any kind of way while I'm employed by her.

Gather all evidence, look for a reporter who willing to help you.
You can threaten to sue but I believe your employer is more afraid of bad publicly than the actual legal action.

It may not cost you anything. You have a Human Rights Commission, or something by a similar name, in the county or possibly city government. Among the things they are responsible for is discrimination against employees and other employer misconduct. It might even be a part of the District Attorney's office, as much of this includes possible criminal charges.

The first thing to do would be a discreet (i.e., from home) telephone call to such commission, and get their referral to someone with whom you can make an appointment to discuss this in detail. They will give you a summary of your options. If suing is the appropriate course, they will tell you how to go about contacting an attorney who will do it for a contingency fee, assuming you have a case.

You must have suffered economic or physical harm, or both, as a result of the person's maltreatment in order to recover damages (i.e., money) in court. But even without that, there may be restraining orders or other court orders to set things right.

U did not mention for how long u have been employed with the company, however, legally for free in our country the philippines, we can seek assistance to our Dept. of Labor. they will send my complains after investigations to my employer. They're suppose to respond for a certain period and if found that their's abuse, the employer is liable and often times has to compensate for any damages occurred.

Check also on your employees manual regarding your case or call on the labor uniion for advise.

You just have to pay the docket fee which is minimal but it increases depending upon the amount you are claiming as compensation and damages.

Simplest and cheapest and maybe the smartest thing is to quit and get a better job.

contact your local employment agency through the county you live in and they will have a rep. that you can talk to
