because he never got to finish the curse therefore he doesn't get sent to azkaban and if you haven't figured it out by now snape is definitely a death eater. snape cured all malfoys cuts that harry did which was actually snapes spell. malfoy is a death eater and gets sent to azkaban at the end of the book.

He didn't get sent to Azkaban because he never finished the curse and plus the only proof they have that he tried to use the spell was Harry's word. Also is anyone were to be sent to Azkaban from that event it would have most likely have been Harry because he did actually perform a horrible spell. Plus Malfoy's father is afterall very powerful and would have found a way to get his son from going there.

Harry himself tried to use the Cruciatus curse. It wouldn't much fun if the hero of the piece spent the last 2 books in prison...
And I wouldn't be too sure that Snape is "really" a death eater. I think the situation is more complex than Harry Realizes.

I think Malfoy wasn't sent to azkaban because he never really got to finish the spell and he proberly wouldn't of been able to because it is said in the book that you have to actually really want to cause someone pain, to hurt them, for the curse to work and we find out later that even though Malfoy hates Harry he doesn't hate him enough to curse him with an unforgivable curse.

if your a fan then you would realize malfoy s atempt would not have worked anyways,according to hte author to use such a curse one has to be very focused and expirience malfroy was not,as for snape being a death eater,the promise he made in the begining the one he could not break he made the same promise to dumbldore
