ok my daughter dad in is jail right now in another state. he has not paid any support in some time now ($11,000) my question is when he comes down here,, we are getting back together,, can he get picked up for not paying support if we are together and he is paying now?

alright people maybe i really did not wan to say why he has been away but that dose no matter why.

and to the one who said about paying back the state , thank you very much i have NEVER gotten money from the state. not food stamps or any thing.

they ketp on adding the money even though he was paying every month. he has only been in jail for 13 days now.

This area of law is incredibly sexist and a good example of lack of due process. Your friend should get a record of all payments, including receipts from you for payments made in cash. He is a father and therefore guilty until proven innocent. he should keep several copies of the packet of records in several places in case he gets picked up and needs some exoneration.
It's good that you are so concerned, you can really help his case but not prevent trouble in all cases. The state sort of takes over sometimes because technically the money isn't yours but your daughter's.

The answer lies largely with your discretion.
Under the Bradley Amendments, the custodial parent is free to forgive some or all of a child support debt. If you received any welfare, however, part of that debt lies with the state and you cannot forgive that.
The best thing to do would be to consult with an attorney. States have little interest in turning a person right around an incarcerating him for child support non-payment. If any of the money is owed to the state, working out an agreement may be in everybody's interests.

sorry I don't have an answer for you but would like to say to the people saying you need to pay back GOV. support ( though you have not used any).
The gov. is paid for by taxpayers, if you work you are paying for it. I have needed food stamps during a rough time, I used it like "real" money and bought healthy food, and use coupons to make it stretch, I only needed that service for two months, as a person who has worked and paid taxes since I have been old enough to hold a job I am entitled to use these services as a hand up, as is every other working TAXPAYER . Don't be harsh on people who need a hand up.

This might sound bad once you read it, but try to keep an open mind.

If the man is in jail now..and not willing or able to pay for a child he helped bring into the world..why would you want to subject your daughter to that? It shows her that it's okay for her future mate to be (in the eyes of some, if not most) a loser. You don't want that for her, do you?

I would suggest that when he is released, you make him get his own apartment near you and date him casually. Do not let him spend nights at your place and do not spend nights there. You need to create a stable environment for your daughter first and foremost.

If he is able to turn his life around and continue paying child support throughout this for a year or more, THEN and only then consider letting him come back into your life on a permanent basis.

He can only be arrested for not paying if you initiate it with the court. I would just carefully consider letting this man back into my daughter's life so soon.

If you were on any kind of government support, yes he can. It's not you that is charging him with the crime of non payment, but the support system. This could be the Food Stamp program or Child Support Division or something like that.

Who is supporting the his kids now? He should pay back the tax payers of America for every penny if you are on welfare as should YOU. And if you are getting back together with this criminal and subjecting your children to him they should be taken away from you. That $11,000 you are talking about could go to your kids education but NOOOOOO... you want him to slide.

It really doesn't matter because the odds are 3 to 1 he will be back in prison in a year and we will be supporting his little brats and him again anyway I am sure.

usually if you are incarcerated you are not obliged to pay support unless you can work during the incarceration period if he was court ordered to pay then he would have to look into the matter to find out about his obligations .

Yep, and I think you are messed up in the head for even considering getting back with a deadbeat scumbag. He obviously doesn't care enough for his child to make sure she is cared for.

One of my best friends busted his leg and couldn't work for months. He went into debt to continue with his child support.

Your boyfriend is also jailbait, what a wonderful influence to bring into your daughter's life! They should write a book about you called: Psychosis Study on Codependency.
