i am 16 and work in a fast food restaurant. if i work 7-5 (10 hours) should i get paid overtime, or do i have to work 40 hours in one week?

Unless you are the manager of the fast food restaurant, you are entitled to overtime because you are non exempt:

You are entitled to overtime after the 8th hour in one day. This is true regardless of whether you signed an agreement that says you should not get overtime (as other people have answered) and regardless of whether you work more than 40 hours a week. But, another way to get overtime is to work more than 40 hours per week. So if you were to work 7 hours a for 6 days, or 42 hours, you would be entitled to 2 hours of overtime.

Hyd, I'm not sure what state you are in, and some state laws are different, but in *general,* overtime is paid for time worked over 40 hours per week. This for sure applies to Oregon and KY. I am pretty sure I'm correct here. So, no matter how many hours you work in one day, unless it tips you over the 40 hour/week scale, you will not receive any overtime pay.

Depends on where you live. I have worked 12+ hours a day sometimes. No overtime because I don't get to 40 hours.

Some places have you get paid overtime after 40 hours total.

Some places have you get paid overtime after 8 hours of work.

It all depends on the employer.

They are required to give you an unpaid lunch for at least 1/2 hour. Overtime is based on 8 hours per day. The 8 hour day can be changed to a 10 hour a day 4 day a week job by mutual agreement.

i think you have to work 40 hours in one week but if you work holidays you should be compensated like Christmas or Thanksgiving you should be paid time and a half or double time for working it

Check with your state board of labor (Dept. of Labor) There are many laws about and against the hours you can and can not work. ex. before 7am and after 7pm. Too many employers get away with overworking,under paying kids. ASK QUESTIONS or have your parents get involved.
