If so could that be why the Harry Potter 7 (Deathly Hallows) be out of line with the other books?

If not why would her title be so different from the others?

We don't know that the title is different. The other titles have been the focus of the book, or some important part of the mechanism or plot. For all we know, the deathly hallows are too. It could be the name of a place, a group, or more likely, since it's a verb, the central action.
JKR was accused of plagiarism before book 5 (OotP) came out, so if it had influenced anything it would have been HBP. The link is coverage of the lawsuit. And, it was an accusation concerning the HP character, not titles or anything like that.
So, I think we just don't understand the title yet. Maybe we'll get more clues:)

The title is not just Deathly Hallows, it is

Harry Potter and the Deathly Hallows

so nothing different from the others.

If she hasn't been accused of plagiarism, she should be. Check out Neil Gaiman's limited series graphic novels 'The Books of Magic' (from DC/Vertigo) which came out well before the first Harry Potter book. It is unbelievable that there has been no uproar over the obvious similarities between the two.
