My Mother IN Law 3 Days ago got Married to a Violent individual.She says she cannot remember the Marriage Ceremony and would not have gone through with the Marriage unless she was Drunk. She is a Registered Alcoholic, Is there Any Legal REcourse for this Marriage to be Annuled.

I don't know about other countries but for the UK this is how the law stands......

Under certain circumstances your M-i-L may be able to have her marriage annulled. She must apply to annul the marriage within a reasonable period of time, in some cases she could still apply up to 3 years after the marraige took place...I wouldn't wait a day longer if I were her though.

Examples of when she may seek an annulment of her marriage are:

The marriage has not been consummated.

At the time of marriage her spouse was already married to someone else.

One of them was under 16 years of age when they got married. (not applicable here)

She has married a close relative.

Her spouse had a venereal disease at the time of marriage and he knew about it but she didn't.

The other person was pregnant with another's child at the time of the marriage and they knew about it but she didn't. (obviously this doesn't apply in her case either) LOL.

She may also be able to get an annulment if she can prove mental illness or that the marriage only went ahead because of being drunk & unable to make a proper decision. (she'd need to get that one checked out though)

What a terrible situation... so sorry.
But yes, she does have legal recourse. BUT, she has had to have left where ever they were living together. I hope this is has already happened.
Then she requests an annulment of the marriage based on:
lasted only 3 days, that she was too impaired by alcohol use, to make a cognitive decision to enter a marriage, and his breach of contract (the marital contract) being a violent, abusive man.

She'll need to look up in the yellow pages, they have Atty. that give you free advise on how to handle this type situating. I don't know about annulment if the marriage was communicated I think a divorce is what she will have to get. I knew a girl but she was real young and the atty. ask her had they communicated the marriage and if she had then she would have to get a divorce, she lied and wasn't cross filed on by the boy and it was annuled..

There is probably some legal loop hole for her to get out of the marriage. Where was the marriage performed? They should have asked them both if they were entering of their free will. If she said "yes" then she may have trouble.

She needs to contact a lawyer right away. The longer she waits the harder it will be to explain that she really doesn't want to be married to this guy.

Sure there is,marriage is a contract and any contract is considered null and void if both or one of the parties were under the influence.She should talk to a lawyer and be guided thru the process.Wish her the best of luck.

It's bad that she married him especially since she was drunk and it's bad that she can't remeber it ethier. I don't know if there is a legal recourse but there's such thing as a nawment (not sure how to spell it.)

Absolutely, it can be annulled! She was drunk and unable to think reasonably, incapicated. She can go to the courthouse and have it annulled.
