If you are applying to a bank they might be interested, depends.
Would feel safe in saying you are not the one with the poor background so, most employers are looking at your skills and assets on behalf of the company.
If you are really concerned, tweak it slightly and let them know your husband got in trouble a "long time ago" and , you would like to know if that will have any bearing on your employment background check.

They are going only to do an background check on you, not your husband. Some companies may not even to do that. They are going to hire basic on your experience,education, etc..

This is YOUR background check, not your husbands.. Some companies will ask for spouse information and run a backgground check on the spouse also - and credit checks. If you were not asked for your spouses information, I would not worry about it.

Some employers won't check that information. Some won't care. Others will be unlikely to hire you. It varies. Sometimes its best to be upfront and tell them before they find out.
