The child in this senerio is thier natural child and lives with both biological parents since the remarriage but the state continues to make them pay child support. During the divorced years mother received state welfare aid for a period of 5 years. Is this right?????

The state can still require it, yes, since the mother was on welfare for so long. When my son was pulled from his fathers custody for abuse, he was temporarily on state assistance, while living with my mother. For the period of time that he was, both me and my ex had to pay almost 4grand in child support back to the state. Even tho he is living with me, full time, and he is no longer on state assistance, I still have to pay child support for the time that he was. So yes, it could be right, just depends on their state laws. Now if he was paying support to her directly (thru your states payment center) and it wasnt going to the state to begin with, I would contact an attorney, cuz if the state wasnt taking it originally, then they shouldnt be taking it now.

Probably.
The welfare costs of the child (child mind you, not the mother) do not go away, so even if they remarry the state may have an interest in getting its money back. I'd check with a lawyer and make sure that you are on solid ground...the last thing you need is for a remarriage to disintegrate because of financial issues.

Yes he should be paying for his children after all they are his children regardless or whether his ex has remarried or not. Likewise he should be paying for the children he has with you and if you have children by another man then their father needs to be paying for them. You have no right to say what you are saying because the bottom line is that they are his kids. If they are visiting their dad, do you stop them from eating anything in the fridge or having a drink because your kids would go without, you probably don't but by the sounds of things you sound as if you would. Your father made this children with his ex, they are his responsibility so he has to look after them, if he doesn't his ex could take him to court and he could end up paying a lot more than he does now.

Yes, you still have to continue paying childsupport unless she files for a modification of child support to stop you from paying it. Plus, if you pay through the state, part of that money may already be going to the state. I am assuming that you may not want to continue that and rather give her the full amount so the kids can fully enjoy the money.

Lets say that you guys end up divorcing again, she can then state that you have not payed your childsupport. And I think you wouldnt like that! Either continue paying your child support, or have her file for modification of child support to stop payments.

I'm guessing that the child support you are paying is going to repay the state. If you are with her, it's coming out of your joint account.

Yes you do! You have to repay the state for taking care of your child. after the state is paid back it should stop are your wife my have to go and stop it.

OK not it's not right because technically the two are together and are both providing for the child i mean it's ridiculous

You have to pay support back to the state, but you shouldn't have to pay any money after you were married. You will always have to pay back support.
