Yeah...up in Grove on Grand Lake they built a new bridge and widened the road...caused my favorite restaurant to go out of business...b@stards!

ODOT typically pays for temporary closings as a part of Right of Way acquisition. Or they will find an alternate access. If no access can be arranged they can do a total take where they buy your out at an appraised value.

I'm not sure what you situation is there are rules about how close to an signalized intersection an access can be, these are sometimes waived for existing businesses.

There is some law that if a roadway across someone Else's property has been used for "continuous access" it can not be closed. I've only seen this used in rural situations where there is no defined section line right of way to properties in the middle of a section. (not a typical business location I know)

And if it's during the course of new road construction, then, yeah, you're SOL.
