real question, if you 2 are together but decide to split which one of you gets the baby,, please dont say you will share cause that never really happens,, i saw this recently were a couple was fighting for a 3 year old raised by both but of course the court gave the baby to the biological mother,, so how about it you non biological lesbain, would you fight for custody of a child you did not have but helped raise, and have you talked about this with your partner

It is the same as a male/female marriage. If the parties can't work it out a judge decides physical custody and the other parent gets visitation.

I've also seen the opposite occur, granted not with as much frequency, but it does happen. If the biological parent can't afford to raise the child on her own or if she is found to be an unfit parent, sometimes the courts will actually rule in favor of the non-biological parent stating they are the "emotional" parent.

Thankfully my partner and I have stayed together for so long that this is a non-issue. Besides, my son has a biological father who's his other parent. My partner, although she raised him moreso than my son's father ever did, his father would get custody if anything were to happen to me.

Not that I ever liked this scenario either.

It really depends on the situation and individual abilities of each of the parents.

The biological mother in all but 4 states. If there is an adoption by both women something only allowed by a handful of states the court decides, usually the one most responsible for child care.

most likely the court would decide who got the child...but I guess that is a loaded question cause gee it could either way..lesbians are people like hetrosexual couples so yes the biological father may not be there but most likely he doesn't know he has a child and that child is in a lesbian home and I guess the question could be ask why did you target just lesbian you know gay men have children also? So why did you put this question just to lesbians?

This case should be treated in exactly the same way as it would be for a straight couple in the same situation. Oh, wait, I forgot, this is America.

Wel if my girl and I were to split, we would share custody definitely. I would never take her away from our childs life completely.
