my son was short by almost 200.00 this month given a cheque instead of paid into bank as usual.also tax code wrong .told he would get single time instead of triple for christmas newyear shifts manager won,t give reason .
after serving grievance letter he is now paying wages due but he seems to think my son is raceist now untrue as some of my sons best friends are Pakistani.WHAT SHOULD MY SON DO NOW AS HE IS BEING IGNORED AT WORK BECAUSE HE ASKED FOR MONEY DUE

There are a number of issues here,

firstly regarding £200 short, i beleive this has now been corrected and may simply be down to communication breakdown between old and new employer.

Being called a racist
Unfounded allegations of racism and themselves forms of discrimination, harassment and racism. ad this with the the fact he is now beingh ignored for demanding his statutory rights to lawful payment of wages and you son would have grounds for a harassment and victimisation claim in an emploment tribunal irrespective of length of service. being ignored atb work is recognised as a form of bullying.

your son would have been protected under the terms of TUPE by which his previous terms and conditions would have transfered to his new employer. This failure can again be taken to an employment tribunal.

the circumstances you have raised would amount to a fundemental breach of the implied contract between an employer and their employees namely mutual trust and confidence. the employer has also failed to abide by TUPE regulation and is now treating your son unfairly and unlawfyully by calling him a racist, ignoring him, witholding contractula rights.

I would strongly recommend speaking to a specialist employment solicitor.

I beleive your son has sufficient grounds to leave and claim constructive dismissal and discrimination and harassment due inpart to the fundemental breach of contract by the employer. I would however sugest continuing to raise a furtther grievance about the above, whether this is whilst still in employemnt or as part of your sons resignation letter.

unfortunatly in a number of TUPE situations new employers have it in their mind to 'force out' the current staff so they can employ their own. the only way this will stop is when action is taken against them.

It sounds like the actual problem is that you are concerned that your son is being ostracised at work, as you say the money is being paid (finally).

Unfortunately, sometimes people in the workplace will have unfair attitudes in this way despite the fact that your son has only sought his rightful due. He pretty much has three options:

1. If he feels his employers and/or co-workers are approachable and reasonable he could find an appropriate situation for an informal chat where he expresses his view that it is unfair for them to make him feel isolated just because he wanted his fair wage.

2. If he feels they are not reasonable, but he wants to continue working for them, he pretty much just to 'tough it out'. As long as he is a good worker, this animosity will soon pass.

3. As a last resort, he might want to consider changing jobs.

Remember, he can't change people - he can only do what he feels to be right himself.

If your son can, find another job and quit. You cannot work in an environment where you are being victimised. As far as the racist issue is concerned. Forget it, don't let them get to you or your son. They are the ones that are being racists. Unfortunately, there is no legislation for Caucasians to play the racist card against non whites. If he has to stay. Tell him just to keep his head down, make sure all his work is logged and signed for, basically ensure that he cannot be sacked by them due to some mistake introduced. £200,000 is a good wage. Even if he has too put up with animosity. Just think about what he's earned that day, then when he leaves for the day, leave all the rubbish he has had to put up with. Go and enjoy himself with the money he has earned from them.
Just in case anyone thinks that what I am saying can be construed as being racists. I am Anglo-Vietnamese, brought up as a Protestant, I have black people who are my carers and friends, my brother was married to a French/Algerian Muslim, so my niece is 1/4 English, 1/4 Vietnamese, 1/4 French & 1/4 Algerian and is a Muslim as well. So I have a perspective from a diverse range of Cultures.

The best thing to do is revenge, Buy some cheap kippers from fish monger and place all around office,factory in hidden places, near some heat if possible or wait until summer comes, and stink the place out, if will cost money in time and effort to find stinky sources and lots of discomfort for them. The worst racistists are none whites as they allways place the race card!!!!

Look for another job, you can't fight the ones with the money and the back up from our gov't because we allowed them to get this far in the US. Wouldn't quit until another job is lined up though. Sounds fishy.

Try to get the money due to him even if he have to take it to small claims and seek another job and the quit.

no matter what nationality every one wants there full entitlement at christmas so tell him to take no notice of the hostilities and just carry on doing his job

he needs to continue taking the steps to ask for his FAIR WAGE i am paki and i know paki people will screw u over a paki pig wouldnt pay me as much as the guys at little ceasers because i was a woman so i quit i should have sued him anyway keep asking and THEN REPORT TO A PROPER STATE AUTHORITY IF HE IS NOT PAID u cannot DENY ANYONE THEIR PAY ITS NOT LEGAL

employers have no right to with hold wages - your son has a right to request for his wages and being labled racist is ridiculous - he does not work for free and his employers need to get their act together. i think they are trying to mess with him

it is not the fact that his boss is Pakistani it is the fact that bosses every where are mostly the same exploit the working force.
