All of my main bills go to my old address in Illinois, like my car payment, credit cards, and such, however I moved to California about a little over 7-8 months ago, and have had odd jobs on / off since I have moved here and I have lived in an Apt. here with my boyfriend for that last about 4 -5 months. Can I still file in Illinois? Or do I have to file here? (Any Illinois or California Lawyers out there that can help with this as well?) Any answers to this question are welcome.

Caveat: I don't practice in either Illinois or California. You need to consult with a California bankruptcy attorney for more specific information.

The US Bankruptcy Code was amended significantly starting in October, 2005. One of the changes involves the exemptions which will be applicable to your situation. The reason this is significant for you is that each state (generally) controls the property that is considered exempt in a bankruptcy. Therefore, although the previous answers are correct in that you can probably file in California, you may not be able to use California's exemptions. (This may or may not be a good thing)

Whatever you do, DO NOT try and file the bankruptcy pro se. The complications that are involved can result in horrible problems for yourself and can result on you paying a bankruptcy attorney many more dollars than you would have originally, to unscrew the mess that has been made.

For a referral to a bankruptcy attorney in California, contact your local or state bar association.

Bankruptcy is covered under Federal law. There is NO residency requirement.

My friend when you are Bankrupt who gives a **** about anything. Just carry on with life, things take care of themselves. You do not have to carry an identifying tag "Bankrupt" for the rest of your life. Life is tough by itself.

So sit down and re-route your life for the better.

Bankruptcy is a federal issue....you can file in any state you reside....it doesn't matter how long you lived there.
