ex wife 8 weeks behind on child support?

my ex wife is behind on child support 8 weeks now, she just started a job this week and child support is gonna be taken out of her check, what am i suppose to do about the back pay?

as to one of the later answers, when child support was set she didnt have a job, i dont and havent bothered her about the child support at all ever, and on top of that she has not ever made one single payment everything shes behind is from the start of the setting of child support

oh and she should have plenty of money since she sold a house illegally for fifteen thouand dollars cash, a house that had been forclosed on, and now shes faceing felony charges of theft over ten thousand

I am so sorry to hear of your problem. It is a sad fact that ex-spouses who won't cought up child support can be of either gender. Shame on her for not caring for her kids financially!

To get the back-support money your children are owed you will have to go through your lawyers and mediation probably to work out some sort of payment plan. It can be done.

Aside from his child support, he is not obligated to provide more. Of course, it is wonderful if he can. He now has a blended family and he cannot show favorites among the children. If it is a financial burden and would unreasonably affect others he has to say no. On the other hand, YOU have a blended family alos and YOU can not show favoritism. I am with my second wife (and last) she has a son from her previous marriage in a very prestigious university. Despite having some scholarships, it is istill more expensive than I planned for education. But we talked about it and we are BOTH willing to make this a prioity. I never use the word "sacrifice" you do NOT sacrifice for your family, you prioritize. We feel, when all is considered, that the BEST education we can provide for this young man is what we should do. We CAN do it, so we do. He is doing excellent and I am sure his future will be better because we prioritized his education. What better could I do with my money? You should have a 50% decision in your family's funds, above and beyond anything he is court ordered to pay, and the EX should have nothing to say in that. NOTHING. If you decide this is the best choice for this young man, then find a way to finance your share.

Well if she wasn't working and thats why she didn't pay you, then just talk to her and see what her plans are, I mean you gotta let her get caught up on her bills and stuff, or she will be out of work again, and technically the courts will let her go if you try to go after it, especially if she always paid before, they might even lower your payments.

If i were you, i would leave her alone and give her time to get caught up, and then approach her, and if your in a financial position where you can , let it go, i would,

She might be able to pay you back at income tax season

its the right thing to do, - just talk to her,

My ex fell thru lots of times, i would tell him he has to make it up,
and he did, and once i was in a place where i didn't need it as much , I would let the little things go.

It should be taken out in small amounts with the current support if the garnishment is through your child support enforcement agency.
Example:
$25 a week for the past due, along with the $100 a week current for a total of $125 taken out per week.

If the support is not being taken out like that, then I suggest that you go talk to your case worker about the back support, and get the garnishment increased to make up for what she hasn't paid.

Generally, they will take that out of her check too (if it is already court ordered, if not you'll have to go to court to get it.). Or you will get the back support back at tax time if she has a refund coming. They will probably add $20.00 or more extra a month until she is caught up (depending on how much she owes. Just make sure Child support enforcement is aware she is in arrears.).

My ex-husband was behind $4,000, got partially caught up, and quit his job-haven't seen a dime for 7months!!!
Usually, the state will give you regular child support, plus arrearages-so much extra per month till she's caught up. Interest can also be added, and you may get her tax refund, if the amount is high enough.
Check with your Child Support Agency, but you WILL get it-even if the kids are 25, she STILL owes it!!!

If it is court ordered....and goes through child support dept...she will have to pay the past due in pymts added into the regular pymts. In NJ, they will suspend your drivers license, or you can issue a bench warrant after three missed payments. I don't know if you want to do that against your ex-wife...but the system can do it with or without your approval...depending on the state

They usually take a little out of every check to help with the arrears, then at income tax time they will nab her check to pay off her back balance on child support.. Good Luck to you..

Even if you take her to cort, it is a commen fact that judges usually lean towards the womans point of view on things. Look, at least she isn't expecting you to clean her house, and fix her car for the next eighteen years. I say be happy with what you get, unless you get nothing. If she doesn't give you ANYTHING... then all you can do is fight. If it comes to fighting remind her and the judge that it took two to make a baby, and it is going to take two to pay for this baby.

I agree with the other comments that you should see what her plans are in regards to back pay and depending on her answer, I would go from there.
