For some people it may seem that it is. So far the courts have moved to uphold individual rights for the most part. When someone does not have money the system gives all the power to the state and wrongful convictions can happen.

It has all the makings of a "Police state", but as long as they maintain regular elections, they should survive with at least the appearance of being a democracy. Disappearences, arrest and being held without charge are already in place, thanks to the Patriot Act.
