If I have 4 children and I have seperated from my husband and I haven't got a divorce yet can I get earned income credit since I have the children and he hasn't seen them or contacted them in over a year?

dont marry someone youll get divorced from. certianly dont have kids with them. problem solved.

It sounds like you can probably be "considered unmarried" for purposes of filing as head of household rather than as married filing separately, so you'll save some money on taxes. But being able to file as head of household still does not qualify you for the Earned Income Credit unless you file a joint return and meet the other requirements, which doesn't sound very likely.

I do not believe that you can file "married filing separately" and still qualify for earned income credit. Look at the website for EIC or call someone like H and R Block for a valid answer. I would see if the X would agree to a certain percentage of the tax refund. it sucks, but I am not sure you have a lot of choice here.

Yes, you can file as Head of Household and get earned income credit as long as you didn't live together at any point in the last 6 months of the year.

Since you've been separated for more than a year, you can claim as head of household and can qualify for earned income credit.

yes you can claim earned income credit as long as you are the sole one supporting them
