Please let me tell you my case and see if you may be able to give me advice. I have very limitied time

No problem. Actually I am his wife speaking on behalf of him while he is in jail.

It was my 15 yr old sister who claimed it. Theres no way to prove it. I was with him when this was suppose to have happened. My sister had no respect for him and neither did my parents. She claimed he fondled her breast when she laid there and preteneded to be asleep. The investigator took what he wanted from the stories and booked him based on her word b/c she is a minor. We dont have money for a good lawyer even thugh i have been talking to them and they all say a public defender wont do what needs to be done. I just dont know what to do. I always knew my sister was cruel and let me make comment this isnt the first time she has said something like this. She was supposevly raped a year ago by a boy her and her friends got drunk with but no one believed her and now out of the blue she claimed this on my husband.

Minor molestation charges are done with the utmost concern for the child and circumstance. If you were "charged"? Evidence would say that you are probally guilty. Law enforcement doesn't want to be wrong......thus they insure they have a good case before they even charge.

If you are looking for a way out of having sexual contact with a minor you have come to the wrong place. All of us feel the same way about child molesters. YOU are the adult and in charge of making the determination between child molestation and a young person of age to give consent.

Plead your case in court!

I have never been charged with this crime but I know a boy who was and I was there at the time , several of us testified for the guy but, he had a public defender or " public pretender" is better he got 20 years in prison now that I practice law I can see that there is no justice in our system, and our country has a 98.8 %conviction ratio, they will convict a man knowing he is not guilty the police and the prosecutor gets a feather in their cap with each conviction, I am really sorry to say this but it is true, I just wish there was something I could tell you that would be helpful, you might be able to help if you could do some legal research at the county legal library to assist your public pretender,,he won't be able to do any research as he is so loaded with other cases,
some or most people are so damn cruel, and most believe every thing a cop or prosecutor says even tho they are the biggist liars out there, I wish you luck.

I assume he has just been arrested and is sitting in jail because you haven't put up bond? Anyway, if it is only her word against his, there is always a chance that the case will get thrown out, but remember, if the prosecution has charges against him for this, it is because they have sufficient evidence against him (more than her word against his). He may have given a shaky statement to the police, or failed a polygraph without telling you. Your best bet is to contact the public defender and find out what evidence they have against him.

Also, realize that if it does become a "her word against his," she will be found less credible if she has had problems with drinking, being a delinquent minor, etc. A private lawyer will not be necessary. Public defenders actually do a pretty decent job.

Overall, if he is innocent, I hope he gets out. If he is guilty, he should be in jail a very long time.

The best advice is for you to be talking to a lawyer. The cops are probably going to come seize your comp pretty soon anyway. Once you are convicted they take your pic and posted on web sites, dont even talk about if you go to prison. I hope you get off if you are innoncent, if you are guilty have fun in prison and dont drop the soap.

why don't you say your case so people can help you.....if you're falsely accused you shouldn't have anything to hide, right?

my dad reckons he was.... only....my brother and i were the ones molested.... sorry im not much more help. Hope you trully are innocent!
