I have payed hoildays and I work the overnight shift, however I would like to swipe out at midnight and go home. My job really dosen't require me to have to stay like a doc or nurse. I did however ask the boss if i could leave at midnight and she said no. Can I fight this and just leave because payed hoildays are a benefit to me?

No. You can check with your HR or your handbook, but my guess is no. If you were to work on the holiday and then finish on a seperate day (overnight shift), you would be compensated then.

You can, if you don't care if you get disciplined, suspended or fired. Do you also work the next night? If not, that's your paid holiday. If you do, then you'd probably either get extra pay for working the holiday, or else another day off.

How do you expect to go about "fighting this"? There is no legal requirement for a company to give you time off or premium pay for a holday, although most companies do.

if you are working into the paid holiday, you should get reimbursed somehow for it..over time..or time off just like everyone else does on that day. i would call the labour board and get exact info of your rights and benefits before taking it up with your boss. Always good to have the legal side of the law with you. :-)
