The school district's job is to educate each child until the age of 21 or graduation, whichever comes first. They also have a duty give each child an appropriate placement. Did the stabbing occur at school? If so, that student should have been suspended for the year or sent to a group home. I'm wondering why the court system let this student fall through the cracks.
Unfortunately, there are students in public schools who shouldn't be there. A local girl was raped by another student, and guess what? The rapist's right to an education overrode the girl's right to be educated in a safe environment. She was terrorized every day she went to school when she saw this idiot.
There are several students attending a local school who have been arrested for various infractions, and they are on probation, and attending school with everyone else. Nowadays, it seems that the criminals have more rights than the rest of us who mind our own business and stay out of trouble.
I can't give you a good legal answer to your question, but I'm sure that the school is making sure that the student is not being deprived of his/her rights to FAPE.
Attending a private school has no guarantees either. A local private school took a student who was suspended from public school for the year for bringing a weapon to school. Why did the private school accept the student? The almighty dollar.

I've known a few people who have only been suspended for a month or two for seriously injuring someone, and they've come back to school. But they were under an agreement that if they did anything again that they'd be expelled. So I'm pretty sure unless they killed that person they are allowed to go.

If the person who got stabbed and was a student in the same school and filed a restraining order, it would not be. That student has the right to a safe environment and not have to face the person who assaulted them. If the person stabbed someone in self defense, away from teh school environment, he has the right to go back to his school.

This situation is not the same as yours, but similar. One of my students was caught and arrested for selling a gun to another student at school. The judge sent him back to the same school and he returned to my class. I was not pleased with this situation, but the judge made the ruling in this case. What could I do?

I hope you aren't a teacher. "Stabbed" has two b's.

Unless the person is under arrest, of course it's legal, remember our system of justice is "innocent until proven guilty."

if the school district does not have an alternative school,they must provide an education for him/her.

um unless they're running from the cops i guess its legal, depending on what state you live in
