Let me explain. She's been letting me take (along with my normal 1/2 hr. lunch break) 2 15-minute breaks each day. She once told me that it was some legal thing. I don't know about that... anyway, TODAY she tells me (knowing FULL WELL that I need my STARBUCKS coffee every day -- nothing else satisfies) that I may no longer take my 15-min. breaks. This is unfortunate, indeed. So, my question is, HOW IS THIS FAIR?! I do her favors all the time and I don't take cigarette breaks like 90 percent of the other people in my office... also, I NEVER EVEN TAKE my second 15-min. break. Is there something I can safely say to her?

It's not fair.And you should fight for it! Go up to her and say something like this: " All my co-workers get their cigarrate brakes, so why can't I get coffee brakes? You know that I can't live without my daily Starbucks coffee so I ask you to pu-lease give me my coffe brakes!"

Federal law does not require lunch or coffee breaks. However, when employers do offer short breaks (usually lasting about 5 to 20 minutes), federal law considers the breaks work-time that must be paid. Unauthorized extensions of authorized work breaks need not be counted as hours worked when the employer has expressly and unambiguously communicated to the employee that the authorized break may only last for a specific length of time, that any extension of the break is contrary to the employer's rules, and any extension of the break will be punished.

Bona fide meal periods (typically lasting at least 30 minutes), serve a different purpose than coffee or snack breaks and, thus, are not work time and are not compensable.

You need to find a new job. Also, you need to be covered under a health plan. Call an insurance agent and buy your own plan. You can buy a short term medical policy ( good for a year) until you find a better job, or a permanent personal policy that you can keep as long as you pay the premiums. Your boss doesn't care about your welfare, otherwise he wouldn't just drop the health insurance after promising it to you. If you get sick, you will be in a host of financial trouble. Best of luck to you. I doubt you have any recourse, because all you could do is sue him for breach of contract. He promised, then reneged. It would be very expensive to hire a lawyer for this--better to get the heck out of there and find a new job. In the meantime, see if you can negotiate a raise and get your own health plan with some of those proceeds.

You're going to have to state your location. Those sort of laws for work breaks depend on your location and also your occupation.

Anyway, nobody NEEDS coffee. You might think you do, but you're letting the caffeine get the better of you. I you certainly don't need Starbucks. Why be sucked in? Starbucks won't give you back all that you invest in the company.

Look into what sort of break system you're entitled to and take your breaks. Drink your coffee if that's how it's got to be.

If you are working an 8 hour day it is a federal rule that you MUST be given a 30 minute (unpaid) lunch and two 15 minute (paid) breaks during the day. Contact the US department of labor if you are not being given what is required by law. The website is www.dol.com (that is D O L).

Usually if you work an 8 hour shift, then you are legally entitled to a 1/2 hour lunch and two 15 minute breaks.

I dont know where you live but here if you are scheduled for an 8 hr shift they have to give you a half hour for lunch and 1 15 minute break a day its the law.Check with your labour relations board

Unfortunately doing favors for her is irrelevant. Depending on your states laws, a break is not always required besides the lunch break. If you had been taking to long on your break then it is one reason she may have taken it away. My only advice is going to Starbucks before you get to work.

By law, employer must let employees take 15 mins break for every 4 hours. You can always check on the ministry of labour board for the best answer.

noit is not fair but by law if you work an 8hour shift 1/2 hour lunch and 2-10minute breaks if she does not allow this there may be some legal things you can do first turn her in to labor and industries
