Saying it is pirating is like saying you tried to hack into it. Saying it is illegal is a knee-jerk reaction that is not accurate. What if I am waling through New York City and log into the Web through a Hotel's Wireless Web connection without even knowing. MANY companies allow free wireless connection and put ads in the pages. You can assume your neighbor does not wish to share his or her bandwidth with you, but it is their responsibility to secure it, not yours. You really do need your own high speed connection. If you try to get into their computer, you are still on the edge, BUT I know from experience, that accessing his computer when there is no notice informing you of trespass, they would even have a hard time prosecuting for that in NY State at least. However, taking files in computer theft.

The problem with asking advice here is that there are a lot of people who don't know what they're talking about.

All radio communication (including wireless signals) are exclusively regulated by the FCC. Wireless internet signals are in the unregulated spectrum, which means they are specifically unregulated by the Feds, and the Feds are the only ones who have jurisdiction to regulate them.
Further, the burden of securing a wireless connection lies on the "broadcaster". If they do not secure their wireless signal they cannot complain if others use it. Period. Using an unsecured wireless access point is not illegal. Period. However, if the "broadcaster" makes any attempt to secure his connection (even poorly), then it is a crime to "hack" into it.

Secured or unsecured, any attempt to access or "hack" into another's computer is considered a crime. So, piggybacking onto your neighbor's system, then trying to access his computer, is illegal. Using his unsecured signal to access the internet, is not.
