After two and a half years separation, I would like to get divorced from my wife. It is (now) an amicable split, with most of the tricky stuff sorted (child care, house sold and split) and we both now have new partners. We both want to sort out the divorce properly but are both skint. How can we do it at minimum cost? Any expereinces to share of what to do or not to do? Thanks

The cheapest way to do it is by yourselves. Do not involve any solicitors. Go to the nearest County Court and they will give you the papers you need to file a divorce petition. If there aren't too many issues still to be settled like children and finances it will be quick and inexpensive. You both need to agree and sign the papaers. Then you just pay the court fees and won't even need to appear at the court hearings.

You could do it yourselves, but I don't recommend that because an attorney may point out things the two of you have not considered. One of you may unknowingly give up rights you don't have to. After two and a half years separation, that's probably even grounds for the divorce so no one even say anything bad about the other. (It's 18 months in Arkansas)

You can get an uncontested divorce in any county in the USA and in some places neither of you will actually have to show up in court if the judge will do it on your affidavits. That's gonna depend on your judge.

You cannot just go to your county courthouse and get papers to fill out because those clerks are not attorneys and can't practice law or give legal advice.

I'd suggest you two go see an attorney together, one file, the other can waive service (saving the cost of a processing fee). In Arkansas you can get an uncontested for about $750 to $1000. You two can agree to split the cost.

Pro Se.... go to your local court house and file your own dissolution of marriage papers. The whole thing from beginning to end should cost you about $150.00
Make sure you have both written and signed the division of all assets and debts. Child support worksheets and calculators are available on line. Or both of you can deviate from the worksheet and come up with your own support obligations. As long as both parties agree it will be quick and cheap.
Tip... most states require all divorcing parents to receive schooling to benefit children of divorce. The cost is around $50.00 per person both parents must attend and all minor children it it 2 classes usually held on saturdays from 8-noon.
If you request that the judge set aside the classes because the 2 of you have been split for 2 years and it is amicable he will most likely do that. However, if you are in and out of court once the divorce is granted he will go back and order the parenting classes.... OUCH
Most people are a little put off by the task at hand .... don't be ... it is a very simple process.

You can do your own divorce. In MD, it's quite easy as long as there are no child custody, property, etc. issues. It looks like you have worked out the tricky stuff. It is highly recommended, though, that you get a lawyer BUT you do not have to. Neither one of you will be able to appeal the decision if you do not get a lawyer. Check with the court system in your state for the proper procedures.

This is easy since you two have worked out the hard parts. What you need to do now is get it down on paper,get it notorized and file it with the courts with a minimal filing fee. You dont need an attorney here so you may if you want to only, is hire a Paralegal who can help if you need it and is just as good as but cheaper than an attorney. Go to Office Depot and buy a Divorce Kit in the section where all the legal forms are. It cost $30. Fill them out (have some friends help you) then take them to the county courthouse to file. All you have to pay are filing fees. There are pages in the kit for custody and child support if kids are involved.

I don't think there is any cheap way to get a divorce. Especially if you hire a lawyer and they love divorces. My friend couldn't afford it but her lawyer is letting her make payments. Its going to cost her 1,500 and she made a downpayment of 500 last thursday.

If you think you have things sorted out to where it's going to be an uncontested divorce, check your local courthouse for regulations on how to file yourself. You don't need lawyers to file for a divorce, you only need them if you want to fight things out. My ex and I got divorced ourselves, we didn't have to pay for anything except the fees to file paperwork.

draw up what each of you wants and what the arrangements for the kids will be...financial arrangements, visitation, holidays, health insurance, college etc. then have an attorney look at it....they will tell you what to do next...cheap is not always the best way to go in a divorce...what you agree on today might be quite different when you are in front of a judge...good luck
