Please help. I want to go to another health club and obviously pay monthly, but will I actually get my money back form the closed gym??

They had clients send their letters to :Office of Secretary of State/ Statuatory Documents.....What is this??

They owe me 420.00 for 7 months not fulfilled on my contract.

Well try the address the company gave you but if you don't feel they are saying anything to you.
Find the your Depeartment of Consumer Affairs office and tell them exactly what happened and bring any letters you got.
I had an insurnace company go belly up on me but in about 2 years I received all the money I paid them in advance. If your expecting it right away.. that might not be possible.

Technically yes, but business hides behind corporate structure so you can't go after the money the owners put in their pockets and they get to do it again, though I suspect it will become harder for them as Congress has changed!!

You need to file a complaint with the Secretary of State, who issues licenses for these places, and do the same with the Civil Division of you States Attorney Generals office.

If you get your money back at all, it will be awhile! They will probably have to find some pockets to get the money!

Never pay these type businesses a year in advance! And that includes Karate schools, unless well known like the YWCA!

I have seen them take a years subscription knowing they were going out of business the next day!

Write a letter demanding payment to the address you listed. They may have filed for Chapter 7 or 11 and you may not get a refund. Check with them, the main office and see if they're offering a refund or compensation to another gym. Just keep the letters going and let them know where you stand, you might be in for an uphill battle.

Sorry, but I don't think they owe you any money- not even an apology. Gyms are not intended to stay in business or even open for business in the first place. The whole thing is a deception on both parties; The "GYM" is just a place or name of the "HOPE" of getting into shape. The "CLIENT" is the one trying to fulfill the dream of "GYM LIFE" by paying the dues or membership fee- both parties have fulfilled their obligations.

Sounds like they are in receivership - they went bankrupt. If that is the case, you have no chance of getting anything back. You are at the end of a long line of creditors, and the govenment, banks, and large companies will get paid first. Only if there is anything left in the company assets will you get any kind of refund, and it won't be for anything like the full amount.

Yes, they owe you money. That's a breach of contract. Even if they file bankruptcy, you call file a petition. Read carefully the letter they sent you.

I don't know how much luck you'll have, but it happened to me, and they gave me a membership in another club. The only reason I'm answering this is so I can tell "Keeper" to shut up!

They do, but likely won't be able to. They probably declared bankruptcy, which is why you were asked to contact the secretary of state. Get your claim in fast as it is likely a first come, first served payout.

Yes of course they have to give it back you did not break the contract they did so by law they owe you a refund and if you call them and threatened that I guarantee you will get a refund....Good Luck...

chances are if the Declared bankruptcy though you aren't getting your money back. They will be ordered to but you probaby wont get it.
