I had a child with a guy four years ago. I took him to court for child support, when my son was 1 yr. old and was awarded the minimum since he was unemployed. He paid support sporadically for a few months and then dropped off the face of the earth. I got married this past summer and my husband, who has been a father to my four year old since he was one, wants to adopt my son and change his last name to reflect our marriage (my son has my last name). I recently called Child support enforcement to see what I needed to do since it has been at least two years since the last support check. They were useless. They said there was a bench warrant against him, but they had no leads. Since he is offering no support, has had no contact, and has made no attempts, I just want to close that door so I don't have to worry about him popping up again. I live in SC. Does anyone know the procedure or have any recommendations? Please help because I have no idea where to start!!

Severing parental rights is a tough thing to do. You need to get an attorney to assist you with both the severance and the adoption of your son.

There are no blanket laws that apply. It is done differently in each state.

Seek legal counsel. That is the safest and easiest way to move forward with your plans for your son.

Your going to need a lawyer for tht but maybe all your husband has to do is try to adop him imm not sure of the way to go but im in the same boat im meeting w/a layer this weekend and hoping I can resolve my situation yours however seems to have a better chance since hes not around but call around to see wht a lawyer would suggest most have free consultations even if its for 30 mins tht should help. good luck hope i helped!!!

Contact an adoption attorney in SC. Ask for an initial consultation and a fee structure. He or she will help you make this possible.

You will have to try to contact him through public notice and family contacts. Your husband will have to go through a homestudy process I imagine.

It will all be worth it in the end.

I would call a divorce lawyer and ask for advice. If this guy wants to be a dad, then by all means start the adoption process. I seriously doubt the loser will show up and try to stop you.

dont know the laws in your state but I think you can file abandonment which will terminate all his rights...then your husband can adopt him. Find a family attorney. its worth the 2k.

first of all get a lawyer and he/she will be able to answer your questions about terminating his parental rights better than we can here
